1. Operator and contact
Art Atlas is operated by ART ATLAS PRESTACAO DE SERVICOS DE TECNOLOGIA LTDA, CNPJ 68.495.144/0001-08, at Rua Uruguai, 297, apto. 501, Tijuca, Rio de Janeiro/RJ, CEP 20510-055, Brazil. Contact us for support, cancellation, complaints, and privacy requests at contato@artatlas.com.br.
These Terms govern the website, catalog, search, favorites, subscriptions, artificial intelligence, and related Art Atlas features. The Privacy Policy for this version explains personal-data processing. Accepting these Terms records agreement to the service rules and acknowledgment of that policy; it is not blanket consent to personal-data processing. Processing relies on the applicable legal grounds described in the policy.
2. Your account
You must have legal capacity to contract, provide accurate information, and keep access credentials secure. Accounts are personal and nontransferable. Sharing an account or credentials, lending, selling, transferring access, or allowing another person to use your account is prohibited. Notify us promptly of suspected unauthorized access. Responsibility for misuse is assessed under applicable law, including the cause of the incident and each party's conduct.
3. Use exclusively within Art Atlas
Access grants a limited, nonexclusive, nontransferable right to consult and use available content only within the Art Atlas platform, for lawful personal or internal professional purposes and within your Plan's features. It does not grant a license to take content or data outside the platform.
Unless Art Atlas expressly authorizes the specific activity in writing, you may not:
- extract, collect, copy, reproduce, download, export, capture, redistribute, publish, resell, sublicense, or otherwise transfer platform content or data outside Art Atlas, whether manually or automatically, individually or in bulk;
- scrape, crawl, harvest, mirror, compile an external database, or use content, images, results, or AI responses to develop, train, enrich, or operate another product, model, or service;
- access or consume Art Atlas APIs or endpoints through custom API clients, scripts, bots, browser automation, or other external tools, even with a valid account, session, token, or paid subscription; authentication does not authorize such access;
- bypass access controls, limits, or technical protections, interfere with operation, compromise security, or help others do so.
These restrictions do not prevent normal browser operation needed to display the platform, assistive technology used for accessibility without unauthorized collection, or services and integrations expressly authorized by Art Atlas within their stated scope. They do not restrict mandatory legal exceptions, your rights over your own personal data, or saving and reproducing these Terms, the Privacy Policy, and your contractual and payment documents for your records and exercise of rights. Contact us before undertaking any other reuse.
4. Catalog and third-party rights
Catalog records, images, descriptions, attribution, provenance, estimates, hammer prices, and sale results may be incomplete, outdated, or inaccurate. They support research and do not constitute an authentication, appraisal, guarantee of ownership or condition, or legal, tax, investment, or financial advice. Verify information with the source and qualified professionals before purchasing, selling, bidding, or making another decision. Art Atlas is not a party to transactions arranged with auction houses or other third parties unless expressly stated.
Art Atlas's software, design, and original content and compilations are protected to the extent provided by law. Artwork images and other third-party material remain subject to their respective rights holders' rights. Display on Art Atlas does not mean we own those rights or can authorize their reuse. Report suspected infringement or inaccurate personal information through our contact channel, identifying the material and the basis for your request.
5. Artificial intelligence and submitted content
AI can produce incorrect or invented statements. Check responses and references independently. Do not submit unlawful material, third-party personal data without a lawful basis, or sensitive, confidential, or privileged information that is unnecessary for your request. You must have the rights needed to submit your content.
To deliver the requested features, Art Atlas processes submitted text, images, conversation history, and responses, including through service providers as explained in the Privacy Policy. You retain any rights you hold in submitted material; you authorize processing needed to operate the requested service. AI output does not create a guarantee of accuracy, exclusivity, or third-party rights clearance.
6. Subscriptions, cancellation, and consumer rights
Paid Plans are recurring credit-card subscriptions processed through Stripe. Review the price, currency, billing interval, included features, and renewal conditions shown before Checkout. Subscriptions renew until canceled. Manage your subscription in Settings or contact us for help. Cancellation normally stops future renewal while access continues until the end of the paid period, subject to the conditions displayed and mandatory law. Failed payments or an inactive subscription may remove paid features.
Mandatory consumer rights prevail. Where Brazilian consumer law applies, the right to withdraw from a distance contract within seven days of signing or receiving the service, as applicable, is preserved, with refund of amounts paid as required by law. Request withdrawal, cancellation, or a legally due refund through the contact above. Nothing here waives remedies for service defects, improper charges, or other statutory refund rights. There is no general forfeiture of payments because an account is terminated. Any price or material subscription change will be communicated before it applies, with the rights required by law.
7. Violations, suspension, and termination
Any violation of these Terms may lead to access restrictions, suspension, permanent account termination, and a permanent ban on the user, including for unauthorized extraction, external API access, or account sharing. Measures will reflect the violation's nature, severity, recurrence, security implications, proportionality, and mandatory rights. Urgent protective action may be taken where necessary; we will provide the reason and a channel to contest the measure when legally and operationally possible. Contact us to request review. A ban does not eliminate your rights to personal-data requests, contractual records, or refunds due by law.
You may stop using the service, cancel your subscription, and request account deletion. Deletion and retention are explained in the Privacy Policy. Obligations and rights that must survive, such as accrued payment obligations, lawful evidence retention, intellectual property, and dispute resolution, remain applicable.
8. Availability and responsibility
Maintenance, outages, and third-party dependencies can affect availability. We do not promise uninterrupted access or error-free catalog and AI content. Each party's responsibility is determined under applicable law. These Terms do not exclude or reduce liability that cannot lawfully be limited, including mandatory consumer protections. Informational limitations are not a waiver of rights concerning the service we supply.
9. Versions and disputes
Terms and their Privacy Policy are published together under one immutable version. Changes to either document produce a new publication; the platform presents that version for acceptance under its account flow. Historical pages remain available so you can consult and save the documents corresponding to your acceptance. A later version does not rewrite earlier acceptance evidence. Changes do not retroactively remove accrued rights.
Brazilian law applies, including the Consumer Protection Code and the General Personal Data Protection Law where applicable. Disputes may be brought before the legally competent court, preserving the consumer's right to their home forum and any other mandatory jurisdiction. If a provision is unenforceable, the others remain effective to the extent permitted by law. Contact us first if you wish to seek an amicable solution; this is not a condition for exercising your rights.
